When you are in a motor vehicle accident, WHICH YOU DID NOT CAUSE, one of the losses you can recover from the other party's insurance company (or often your own if the other party is uninsured) includes property damage to your vehicle. However, another “property” loss which is often overlooked is what is called “Diminished Value”. Simply put, this is the difference between the value of a vehicle prior to and after an accident. Similarly, another “property” loss often minimized is when the vehicle is declared a “Total Loss”, as the carriers’ value for a “total” is usually much less than what you deserve.
Through our process, which requires only that you forward us the date of the accident, VIN number, and miles on vehicle, we run the analysis and provide you with documentation proving the diminished value or, in the case of a total loss, the appropriate total loss value for the vehicle, which you can then submit to the carrier for settlement.
In essence, very little. Once you forward us the above-stated information, we do the rest of the work. Your only job upon receipt of our report is to collect the additional damages from the carrier that would have been previously left on the table.
Most consumers are not aware that they are entitled to additional property damage monies from either Diminished Value or a Total Loss. Armed with this knowledge, and our expert report, you can now put extra money in your pocket, to which you are entitled.
If our analysis results in only a marginal amount of diminished value or in a minimal difference between the total loss we determine as compared to the amount determined by the carrier, we will so advise you as you may choose to not have us render a report. In this case, there is no charge to you.
When our analysis results in a real number, and it thus becomes worth your time to submit, our fee is a flat rate of $495.
"Due to the negligence of another party, this vehicle has lost market value. General Negligence tort law states ... Consider the difference, if any, in the market value of the vehicle in question immediately before the occurrence in question and immediately after the necessary repairs were made to the vehicle."
The insurance company will not accept your opinion that you have suffered a Diminished Value/Total Loss, and many insurance companies will tell you that there is a standard formula used for Diminished Value. In fact, that is untrue. There are many factors to be considered when assessing Diminished Value. For this reason, consumers would be wise to hire an independent Diminished Value expert to supply an accurate report.
