As you know, the likelihood of success on any legal matter is correlated to the quality of the documentation that you present to your adversary or the insurance company. Given the position taken by the carriers, particularly when it comes to Diminished Value/Total Loss claims, you need to be armed with the most accurate and professional documentation to successfully submit these claims. My expertise enables me to render reports that offer you credibility and a factual basis to support your position when negotiating with the carrier.
I understand that everyone has to "win" in this situation. For this reason, I offer a complimentary evaluation of your client's potential claim prior to creating the report. If, after my analysis, there is not sufficient evidence to support a meaningful claim, I will not create the report and there is NO CHARGE to you. It is only after you give me permission to write the report that I do so. I also charge on a flat fee basis rather than a contingency fee to avoid any appearance of bias or self interest. Operating in this fashion has afforded me strong professional relationships with the attorneys, nationally, with whom I do business.
In each and every report I certify to the following:
I have made a commitment to not only building but sustaining my professional relationships with my attorney clients, based upon my understanding of attorney client privilege and the goal of becoming part of your team of experts.
When your clients are in a motor vehicle accident, one of the losses you recover for them includes property damage to their vehicle. However, another “property” loss which is often overlooked is what is called “Diminished Value”. Simply put, this is the difference between the value of a vehicle prior to and after an accident. Similarly, another “property” loss often minimized is when the vehicle is declared a “Total Loss”, as the carriers’ value for a “total” is usually much less than what your client deserves.
Through our process, which requires only that you forward us the date of the accident, VIN number, and miles on vehicle, we run the analysis and provide you with documentation proving the diminished value or, in the case of a total loss, the appropriate total loss value for the vehicle, which you can then submit to the carrier for settlement.
In essence, very little. Once you forward us the above-stated information, we do the rest of the work. Your only job upon receipt of our report is to collect the additional damages from the carrier that would have been previously left on the table.
Your clients now put extra money in their pocket, which most other attorneys neglect to recover. When you tell them at the initial consult that you will get them everything to which they are entitled, you have now honored that promise.
· No cost to you as the attorney – our fee is a cost to the file that ultimately gets charged to the client as an expert fee (see pricing below):
· Additional fees in your pocket for very little effort and time on your part;
· Enhanced credibility in the eyes of your client for going “above and beyond” what most other personal injury attorneys do for their clients;
· Your clients benefitting from your extra efforts results in increased client satisfaction, better client retention and more client referrals.
If our analysis results in only a marginal amount of diminished value or in a minimal difference between the total loss we determine as compared to the amount determined by the carrier, we will so advise you as you may choose to not have us render a report. In this case, there is no charge to you.
When our analysis results in a real number, and it thus becomes worth your time to submit, our fee is a flat rate of $495. This becomes a client expert fee as any other you utilize during the course of the case.
